Understanding a 90-day trial period: why it doesn't apply to AEWV.
Pause on the median wage rate increase for the Accredited Employer Work Visa!
The current pause in effect means that the wage rate for workers under the Accredited Employer Work Visa will remain constant at NZD $29.66 per hour. This pause also extends to median wage prerequisites for the partners of these workers.
Furthermore, it's important to note that all other sector agreements and exemptions tied to the median wage will persist, maintaining alignment with the current rate.
As of February 2024, the updated median wage of NZD$31.61 per hour will persist for other visa categories, including the Skilled Migrant Category and Parent Category.
Further details regarding upcoming median wage adjustments for the Accredited Employer Work Visa will be informed at an appropriate time.
Understanding a 90-day trial period: why it doesn't apply to AEWV.
As we know that the New Zealand Government has announced its plan to extend 90-day trial periods to all employers, marking a significant development as of December 11, 2023.
However, it's crucial to keep in mind that accredited employers are excluded from this legislation. This means that accredited employers and those under the AEWV (Accredited Employer Work Visa) won't be affected by the extension.
In a related update from October 29, 2023, accredited employers experienced a shift in rules, preventing them from utilizing 90-day trial periods in employment agreements.
For those utilising job check applications, it's essential to be aware that employment agreements provided in this context should not incorporate a trial period. Employers taking this risk may face the potential revocation of their accreditation.
Detection of breaches could occur during the job check process or through subsequent post-decision and reaccreditation checks. Stay informed and compliant!
